If a parent lives in another state, the question may arise as to which condition is competent to determine custody of the children. If you find yourself in a situation where the other parent has harmed or has the potential to damage your child, you should try to obtain sole custody to protect your child. A child should not live with a parent who is abusive, insulting or dealing with a substance abuse problem. If one of these offences occurs, the parents can reach a new agreement or bring the other to court. If the agreement has been approved by a court, they will return to that court to enforce the order. If the agreement has not been approved by a court, the parent can obtain the usual remedies to enforce the agreement.
If you read the sections of the Family Law Act 1975 – relevant sections of this guide – you will find that it does not speak of “retention” and “access” or “stay” and “contact.” These are terms used so far in family law. Instead, there is now talk of making “arrangements” for children, including where the children will live (“lives with”) and how often the children see and talk (“pass time and communicate with”) with other parents (and grandparents and other large families).
